Welcome to South Evian Gulf team‘s exhilarating sea kayaking tours! Before you embark on an unforgettable adventure, please take a moment to review our terms and conditions outlined below. By booking a sea kayaking tour with us, you agree to comply with these terms.

Amendment of Terms and Conditions

South Evian Gulf team (“SEGT“) reserves the right to modify or amend these terms and conditions at any time without prior notice. It is the responsibility of all users of our services to stay informed about any changes.

Activities and Equipment Usage

All participants are required to engage in activities in the presence of SEGT instructors. This is both to ensure the proper use and protection of our equipment and for photography and filming purposes. Participants must adhere to safety guidelines and instructions provided by SEGT instructors.

Eligibility Criteria

Participants must meet the eligibility criteria as outlined by the American Canoe Association, including but not limited to being able to breathe independently, maintain a sealed airway underwater, hold their head upright without support, manage personal care and mobility, and effectively communicate. SEGT reserves the right to refuse participation to anyone we deem unfit for the tour due to health or safety concerns.

Age Restrictions

Participation in our activities is limited to individuals aged 18 and above. Participants aged 16-18 may take part under the responsibility of their guardians and must be accompanied by them.

Health and Acknowledgment

By participating, individuals acknowledge that they are in good health and proper physical condition to engage in paddlesports. They understand the risks and dangers associated with the activities, including serious bodily injury, permanent disability, paralysis, and death.

Reporting Health Problems

Participants are required to inform SEGT instructors of any health issues before engaging in outdoor activities. This information is treated confidentially and is crucial for ensuring participant safety.

Leave No Trace

SEGT operates according to the Leave No Trace principles, promoting environmentally responsible outdoor practices.

Challenge by Choice Approach

SEGT follows a “challenge by choice” approach, respecting participants’ individual comfort zones. Participants have the right to opt out of activities without fear of embarrassment or peer pressure.

Reservations and Deposits

Reservations can be made through our website, email, or phone, but are confirmed only upon receipt of a booking confirmation from SEGT. To secure a reservation, a 30% deposit is required from the customer.

Prices are subject to change without notice, but if you have already booked, the price at the time of booking will be honored.

Cancellation Policy

Cancellations made by participants:

  • Cancellations made more than 14 days prior to the tour will receive a full refund.
  • Cancellations made 7 to 14 days prior to the tour will receive a 50% refund.
  • Cancellations made less than 7 days prior to the tour will not be eligible for a refund.

Cancellations due to weather or unforeseen circumstances:

  • In the event of tour cancellations by SEGT due to weather or unforeseen circumstances, participants will receive a full refund or the option to reschedule.
  • We are not responsible for any additional expenses incurred by participants due to cancellations.

Instructors’ Authority

Participants must accept the decisions of SEGT instructors. Instructors have the right to exclude participants whose health or behavior might compromise the safety or progress of the program.

Route and Program Changes

SEGT reserves the right to modify, postpone, or cancel a route or program due to safety concerns or insurmountable reasons. In case of cancellation by SEGT, participants are entitled to a full refund.

Promotional Material

Participants acknowledge that they may be photographed or filmed during activities. This material is SEGT’s property and may be used for promotional purposes. Participants who do not wish to appear in promotional material must submit a written request before the end of the activity.

Limitation of Responsibility

While we take all necessary precautions, sea kayaking inherently involves some level of risk. Participants join the tours at their own risk. SEGT, its instructors, and staff are not liable for any personal injury, loss, or damage to personal belongings during the tour.

Data Protection and GDPR Compliance

SEGT values your privacy and is committed to protecting your personal data. When you book a sea kayaking tour with us, we may collect and process your personal information in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

We will only use your personal data for the purpose of processing your booking, providing you with tour information, and ensuring your safety during the tour. Your data will not be shared with third parties for marketing purposes.

You have the right to access, rectify, or delete your personal data held by SEGT. To exercise these rights or for any data-related inquiries, please contact us.

Damage to Equipment

SEGT provides all necessary sea kayaking equipment. Participants are responsible for the proper use and care of the equipment during the tour.

Conduct and Respect

Participants are expected to treat instructors, fellow participants, and the environment with respect and consideration. Alcohol and illegal substances are prohibited during the tour. Participants must follow local laws, regulations, and guidelines throughout the tour.
